Terms of Service
Last updated: [Month Day, Year]
These terms govern your use of GymOS. By creating an account, you agree to them. Please read the cancellation section; we mean it when we say there's no long-term contract.
The service
GymOS is software for running a gym: scheduling, attendance, membership billing, athlete development, and a branded website, offered as a monthly or annual subscription with a 60-day free trial.
Accounts
You're responsible for the accuracy of the information you provide and for keeping your account credentials secure. A gym admin is responsible for the accounts they create for their own staff and members, and for obtaining any consents or waivers their members need to sign under applicable law.
Subscription and billing
Subscriptions are billed monthly or annually in advance through Stripe. Plan prices are shown on our pricing page. We'll give reasonable advance notice before any price change takes effect for existing subscriptions.
Cancellation: no long-term contract
You can cancel anytime, with no cancellation fee and no minimum term. Cancel instantly and self-serve from your dashboard's billing portal (powered by Stripe). There's no need to call or email anyone. Your subscription stays active through the end of the billing period you've already paid for, and won't renew after that.
Canceling stops billing; it doesn't delete your gym's data. If you come back later, your records are still there. If you'd like your data deleted instead, see our Privacy Policy for how to request that.
Your data
You (the gym) own the data you put into GymOS about your business and your members. We act as a service provider processing that data on your behalf; see our Privacy Policy for details, including our commitment to never sell it.
Acceptable use
- Don't use GymOS for anything illegal or to violate anyone else's rights
- Don't attempt to disrupt, reverse-engineer, or gain unauthorized access to the service
- Don't use the service to send spam or unsolicited marketing outside its intended features
Third-party integrations
Some features connect to third parties you choose to use: Stripe for payments, and optionally Meta/Instagram for social publishing. Connecting these is your choice, and your use of them is also subject to that provider's own terms.
Intellectual property
GymOS and its underlying software remain our property. You retain all rights to the content and data you and your members create using the service.
Disclaimers and limitation of liability
The service is provided "as is." See our service level goals for our operational commitments. To the maximum extent permitted by law, we aren't liable for indirect, incidental, or consequential damages arising from your use of the service.
Termination
You may cancel at any time as described above. We may suspend or terminate an account for material violation of these terms, with notice where reasonably possible.
Governing law
These terms are governed by the laws of [State/Country], without regard to conflict-of-law principles.
Changes to these terms
We may update these terms from time to time. We'll update the "Last updated" date above, and for material changes, we'll provide more prominent notice.
